Ex-Governor’s Case. Sentences left without changes

The judge Zhaidarbek DiarovThe complaints of the condemned in relation to “ex-governor Bergei Ryskaliev’s case” the appeal judicial board on criminal cases of Atyrau Oblast regional court left without satisfaction. The sentence concerning the condemned was left without change. The announcement of the decision on the this case took place on March 17.

The meeting lasted 6 minutes, and the reading of the resolution related to criminal case of the former government officials of Atyrau Oblast, as well as businessmen regarding their sentences took less than a minute.

The sentence of the specialized interdistrict court on criminal cases of Atyrau Oblast in relation to the following condemned:

former first deputy governor Bolat Daukenov (15 years in a corrective colony of a high security with confiscation of property);

former deputy governor Askar Abdirov (12 years of a high security with confiscation of property);

former deputy head of state company “Construction Management of Atyrau Oblast” - Ibragim Amirov (4 years of a general regime with confiscation of property);

former lead engineer of “Passenger Leasing Company”- Azamat Kurmantaev (7 years of a general regime with confiscation of property;

former head of finance department - Baurzhan Dzhantemirov (4 years of a high security with confiscation of property);

former head of regional management of construction Nurlan Kenzhebekov (8 years of a general regime with confiscation of property);

former head of regional energy division Baurzhan Dzhaisanov (7 years of a general regime with confiscation of property);

former director of Asizmarkets LLP Kairzhan Kadyrov (2.5 years of improsonemnt in the standard regime penal colony);

former Mayor of Atyrau - Askar Kerimov (3 years with confiscation of property);

former director of Batystransport SIM LLP - Rakhmetolla Alshenov (8 years of a high security with confiscation of property);

former deputy director of "Gosekspertiza" Ulan Kuralbaev (7 years of a general regime with confiscation of property);

former director of "Gosekspertiza" Turlanbek Dzhiyenbayev (8 years of a high security with confiscation of property);

former director of Stroyltd LLP Eduard Durmanov (5 years of a general regime with confiscation of propert);

former director of “Arkaim 2005” LLP Alexander Kuzema (7 years of a general regime with confiscation of property);

unemployed Alexander Koritskiy (11 years of a general regime with confiscation of property);

former chief accountant of Aktobekhauskonstrakshn LLP and BNB Construction LLP Gulnar Azbergenova (was fully justified due to absence of proof) – was left without change.  

All petitions of the condemned and their lawyers have not been satisfied.  

The chairman judge Zhaidarbek Diarov announced the right of the condemned to address to cassation instance within 6 months from the date of announcement of the resolution.

Actually the resolution was a surprise to many attendees: after two months of considering the complaints of dozens of condemned and the results of repeated examinations (many of them revealed gross violations made during initial examinations), of considering petitions, evidences presented by new witnesses, etc., the result was an absolute consent with the ruling of the first instance court. There was an impression that the court process was just a formality.

The condemned who gave their comments right in the courtroom, called the resolutions of both courts  “a judicial outrage” and declared that they intend to use the right of the appeal.
